These Terms & Conditions (“Terms”) govern your use of the web-based service located at https://draggen.io (“Draggen”, “we”, “our”, “us”) including all features, tools, documentation, subscriptions, and related services (collectively, the “Service”). By accessing or using the Service, you agree to these Terms.

1. Eligibility

You must be at least 13 years old to use Draggen. If you are under 18, you must have permission from a parent or guardian.

2. Account Registration

Certain features require you to create an account. You agree to:

  • Provide true, accurate, current, and complete information.
  • Keep your login credentials secure.
  • Be responsible for all activity under your account.

3. Use of the Service

You agree to use the Service lawfully and only for its intended purpose: creating, storing, and generating creative assets using spatial generative AI. You may not:

  • Reverse engineer, copy, modify, or misuse any aspect of the Service.
  • Interfere with the operation or security of the Service.
  • Use the Service to infringe others’ rights or distribute harmful content.

4. Subscription Plans and Billing

Draggen offers both free and paid subscription plans:

  • Free (“Explorer”) plan: provides a limited number of monthly generation credits and stores moodboards locally in your browser.
  • Paid (“Creator”) plan: includes additional monthly credits, cloud storage, priority support, and access to higher-tier models.
  • Paid (“Archivist”) plan: includes cloud storage, standard support, and pay-as-you-go access to models.

Billing terms

  • Payment is processed through third-party payment providers.
  • Subscription fees are billed in advance and are non-refundable except as required by law.
  • You may cancel at any time; however, access to paid features continues only until the current billing period ends.

5. Credits and Usage Limits

Draggen uses a credits system to meter AI generation:

  • Your plan determines the number of credits allocated per period.
  • Unused credits may expire at the end of each billing cycle.
  • Draggen may modify credit allocation and pricing with notice.

6. Intellectual Property

All code, UI/UX, designs, graphics, and documentation on the Service are owned by Draggen or its licensors. You may only use what’s provided to you under license here — you do not acquire ownership of the underlying system.

7. User Content

You retain ownership of content you upload or generate. By submitting content, you grant Draggen a worldwide, royalty-free license to use, distribute, and display it in connection with the Service.

You represent that you have all rights to any content you upload or generate and that it does not violate applicable laws or third-party rights.

8. Data Storage and Privacy

  • Free accounts: data stored locally in your browser.
  • Paid accounts: data stored in cloud storage on Draggen’s servers.

Your use of data is also governed by our Privacy Policy (linked on the website).

9. Termination

We may suspend or terminate accounts at any time for violation of these Terms, inactivity, or non-payment of subscription fees.

10. Disclaimers

The Service is provided “as is” without warranties of any kind. Draggen does not guarantee uninterrupted access or specific results.

11. Limitation of Liability

To the fullest extent allowed by law, Draggen is not liable for indirect, incidental, or consequential damages, including loss of data or profits.

12. Indemnification

You agree to indemnify and hold harmless Draggen and its affiliates from any claims arising out of your use of the Service or violation of these Terms.

13. Changes to Terms

We may update these Terms. Continued use of the Service after changes means you accept the updated Terms.

14. Governing Law

These Terms are governed by the laws of the Netherlands, without regard to conflict of law principles.
